dilatory defense : In chancery practice, one the object of which is to dismiss, suspend, or obstruct the suit, without touching the merits, until the impediment or obstacle insisted on shall be removed <[‘respondeat ouster’ means] let him answer over; that is to say, when a dilatory plea put in by the defendant has been overruled by the court, let him put in a more substantial plea, or answer over in some better manner – JBS> • non-issuable plea(s) : those upon which a decision would not determine the action upon the merits, as a plea in abatement • procedural defense
